On July 1st, 2024, the Immigration Services Act , officially replaced the Foreign Worker Recruitment and Immigration Services Act, consolidating all immigration-related authorities under a single legislative framework mandating all immigration recruiters and consultants in Saskatchewan, to be licensed by the Saskatchewan government.
Key Highlights:
Licensing for Recruiters and Consultants: Recruiters and immigration consultants must now be licensed by the Saskatchewan government. This ensures they meet qualifications and are held accountable for their actions. Financial security protects victims of violations, and transparent contracts safeguard both employers and immigrants.
Employer Registration: Employers must also register with the government (except for specific situations). They are responsible for hiring costs, verifying recruiter licenses, and ensuring accurate job information is provided.
Protections for Workers: The ISA bans unfair practices by recruiters, such as charging fees to workers, withholding documents, or providing false information. Workers can seek compensation if they are wronged.
Strong Penalties: Violations by recruiters or employers can result in severe penalties, including losing the ability to operate in Saskatchewan, be prevented from hiring foreign workers, and hefty fines up to $750,000 for an individual and $1,250,000 for a corporation.
Supportive Environment: This new act is seen positively by immigrant rights groups who believe it creates a more welcoming environment for newcomers.
Using unlicensed consultants can lead to the refusal of your application. Before hiring a consultant, verify that they are listed among Saskatchewan's Licensed Immigration Consultants. This ensures that your application is handled professionally and meets all the program's requirements.
