Can My Spouse Join Me? The 2026 Guide to SOWP for PGWP Holders

Are you a recent graduate or currently on a Post-Graduation Work Permit (PGWP) wondering if your spouse can join you and work in Canada?


While the Spouse Open Work Permit (SOWP) is a fantastic pathway for families, the rules changed significantly in 2025 and 2026. Simply holding a PGWP is no longer enough. Success now depends on two major pillars: the length of your permit and the specific type of job you hold.


We recently celebrated a successful SOWP approval for the spouse of a PGWP holder. This success was the result of proactive planning ensuring the client met the strict 16-month validity requirement and held a qualifying job in a high-demand sector.

The Two Non-Negotiable Requirements


1. The 16-Month Validity Rule


Under the current IRCC regulations, the principal PGWP holder must have at least 16 months of validity remaining on their work permit at the time the spouse’s application is submitted.


Important Note: If you have 15 months or less remaining, your spouse is generally ineligible for this permit. This is why we advise students to start their job search before graduation, the clock starts ticking the moment your PGWP is issued.


2. Qualifying Job Categories (TEER 0, 1, 2, and 3)


Your eligibility to support your spouse is tied directly to your National Occupational Classification (NOC) code and its TEER level.


  • TEER 0 & 1: If you are working in management or professional roles requiring a degree (e.g., Software Engineers, Marketing Managers, Accountants), your spouse is eligible.

  • TEER 2 & 3: This is where many applicants face challenges. Only select jobs in these categories qualify. These are limited to high-demand sectors such as:

    • Healthcare and Natural Sciences.

    • Technical Trades and Construction.

    • Agriculture and Natural Resources.

    • Note: General office, administrative, or retail roles in TEER 2 or 3 often do not qualify.

Some Mandatory Documents Required

To build a convincing application that avoids a refusal, you must provide more than just a job title. IRCC expects a complete package, including:

  • Detailed Employment Letter: This must include your NOC code and a list of duties that clearly match the "high-skilled" or "in-demand" definition.

  • Proof of Employment: Recent pay stubs and your original offer letter.

  • Work Permit Copy: Evidence that you have the required 16+ months of validity.

  • Relationship Evidence: Marriage certificates or Statutory Declarations of Common-Law Union (IMM 5409), along with shared financial or residential documents.



Beyond the Basics: General Eligibility


Meeting the 16-month and job requirements is the "gatekeeper," but every applicant must also meet general eligibility criteria:

  • The applicant must be admissible to Canada (no criminal or medical issues).

  • The relationship must be proven "genuine" and not entered into primarily for immigration purposes.

  • The principal applicant (you) must be physically living or planning to live in Canada while working.
